if u file for 140, chances are that it will get approved before may 2007 is high. If u have an approved 140, you can get 3 year extension. If you seek extension based on labor, you will get 1 year extension. I recommend u to apply for 140 (if possible premium) ASAP. Even otherwise,you are fine to get an year of extension.

I guess posting this was the trigger for USCIS to send the approval. I got the CPO mail in my email a few mins ago!

You need to have PT license to work. Every state has different rules, there is lot of paper work involved to sit for license exam. For Indians, mostly it was easy for Michigan, New york. For present scenario better check physicaltherapyforum.com, very good info avaliable
Once you pass license it is easy to get job and H1, presently physical therapy is recession proof. well paid over 60-75000 for new grads.

Hi all,
If anyone knows TSC fax number, can you please share that with me. I am a July 2nd 485/ EAD/ AP filer and I didnot receive my AP yet. My H1 visa got expired and i need to goto India ASAP.

I am seeing a trend here, that AP approved but taking 3-4 weeks in being printed and mailed and the online status is not being updated.

If your PD is current and AOS case is approvable exept your FP which is more than 15 months old then you might get a FP notice to have it done before USCIS approves the AOS application.

Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

There is no grace period for stay. But any thing less then 180 of overstay is excused based upon your difficulties. But if you cross 180 days then you cannot enter US for three year. (Search for three year ban)

Here is something we really should watch closely. US senate race in Massachusetts between Democrat Coakley and Republican Brown. They are fighting for the vacant seat of Hon. Late Senator Ted Kennedy. Now, people would think, why a race in mass. matter? It's a completely blue state, and had no republican senator in last 40 yrs, obviously a democrat would win. The election is on tuesday and the ground reality seems to suggest something else.
This seat is crucial for President and Democrats as it is the much coveted 60th seat in the senate to get a filabuster-proof majority which democrats have enjoyed so far. It is critical for healthcare reform as well as for immigration reform (if at all it comes).
The gap between both the candidates was narrow with democrat leading but today, for the first time, polls indicate that Brown has taken lead over Coakley. People in this blue state seem to increasingly support Brown, mainly frustrated because of healthcare policies. Mass residents already have a healthcare related tax to help run state's universal health care. On top of that, federal health overall would be adding more taxes on people and people fear that they will end paying both. Already, mass is a very high tax state. So, there is an increasing popularity to tax-related fiscal conservative campaign run by Brown.
This is surely gonna be a nail-biter; so let's wait and watch this one. Election is coming tuesday.

My I-140 is also pending in Nebraska, I am also in EB-3 category with labor PD 02/20/2007. Your labor PD is 03/2007 and hence it is surprising! I saw an approval for one EB-3 filed in April 2007 in but his PD is 2002.
I do not see any LUD these days in my pending I-140 and I-485. There was a soft LUD in my wife's I-765 (EAD already approved and received) about a month back.
Please keep us updated.

I checked the German Mission in the US website and there I-797 is not mentioned among the documents permissible as exception for Transit Visa. Best is to call the German Mission and confirm. When I spoke to them it looked that they were already aware of this confusion and gave me a definitive answer that I didn't need the transit visa.

Unfortunately , it is true. I personally know a friend whose I-485 was denied even without issuing any NOID or RFE. Reason, well its very obvious, the underlying I-140 was revoked, even though it was past 180 days. By law, your supposed to get NOID or RFE. but some IOs are ignorant and do not know the AC21 laws properly. So they issue straight denial. The number of cases are few because not many companies revoke I-140 past 180 days. But few companies do and some have to do it. So in these situation yes, chances are that you will get a straight denial and that is why there is thread to lobby efforts to raise some concerns to Ombudsman about these erroneous denials.
