My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

Usually change-of-status applications are considered abaondoned if one leaves the country but not extension-of-status. I do not see any problems with their travel here. Gurus?

Maximum 6 entries are allowed each year under AP, as per a 1998 circular of DHS. You may have to be careful.

This question is for an attorney:
My spouse's case is this: She has applied for AOS I-485 (India) based on an underlying EB3 I-140 (PD feb. 2007) petition during July 2007. At that time she had also applied for an EB2 NIW self petition, which was recently approved in April 2009.
Two issues arise now:
a) The PD date of the newly approved I-140 is August 2007.How do we inform USCIS to capture previously approved EB3 I-140's PD. She has used AC21 to port to same or similar job, but he previous EB3 I-140 has not been revoked. Is it possible to capture previous PD?
b) Do we have to send new I-485's or can we ask USCIS to interile newly approved EB2 NIW I-140 to the already submitted I-485s. If yes, how do we do that ?

No, not necessarily in my opinion. She has legal F1 status and that is what you will show on the relevant forms.
I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
Will appreciate if anyone has had similar experience and is willing to share.

Hello all, please share your thoughts/advice on my case.
Worked for Employer A from May 2004 - April 2007
I-140 approved for Employer A in January 2007 (EB2 Category)
Changed job in April 2007 to Employer B (my current employer).
I-485 filed in July 2007 using approved I-140 from Employer A, and a letter for future employment.
Employment verification RFE received in June 2009
My lawyer advises to use AC21 and provide employment verification letter from my current employer (Employer B) for this RFE response.
Since my I485 filing was based on future employment and I did not work for Employer A for 180 days after filing I-485, this causes some complexity.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

This is forum for LC Sub cases. I'm on last phase of my L1B(5 years would complete on 2009) so my company a large corp evaluted my case as fit for LC Sub and applied I-140 on July 4th and 485 on July 27.
I have no status on my I-140/485 or 131 since got the Receipts. Got EAD.
Even after my FP the case also was not updated.
Question:
If you have filed your I-140 LC Sub are you seeing any progress on your file?
If yes, which date your I-140 was applied?
Was that standaline or Join filing with I-485?
Which Service center is handling your case?

My wife's AP is expiring in mid of October 2010. I am going to apply for her new AP before she travels to India in the 3rd week of July. Is there any issue if she comes back with the new AP? As the renewed AP will be received while she is in India. She will leave with her existing AP and enter back (lets say in Nov 2010) with newly renewed AP.

In my petition I gave details of current client.
Today an Agent came from USCIS for an onsite(client-side) visit and verification.
The agent asked me various question mostly related to my petition
I was told my name was picked up randomly.
It is part of USCIS Site visit and verification Program
Anyone has a similar experience?

I am currently on H1-B, however, I was not staffed on any project and hence was not paid for the past one year and two months. Now I want to apply for a change of status to H4 and found that I may need to provide recent pay stubs for 2-3 months. I was not aware of the rule that in such case one should file a COS within 180 days of H1-B activation. I spoke to my employer about this and he asked me to file for a COS without submitting any pay stubs. In case a RFE comes asking for pay stubs etc, he said we would provide a letter stating that due to personal family problems and relocation problems I was not able to join any project.
In fact my employer informed me that there were 5 other employees who had the same case recently. All of them had applied for a change of status without any pay stubs and only one of them got an RFE and the above stated letter was sufficient for the RFE response and the COS was subsequently successful.
I wanted to get advice for the best course of action for filing my Change of Status.

TO HRPRO: Thanks for your advise, going back to do the formalaties wont be an option, but yes she can go back to apply from over there for a H4, we are planning to send our docs to the embassy so that we can get a marriage certificate from her country, will that help?
