masala_dosa, this is my understanding. once you have applied for EAD, its your responsibility to keep it valid all the time, independent of if you are using the EAD or NOT. You have to appy for renewals before it expires etc. i dont know if it impacts the current gc process or not.
two scenarios:
If you are using EAD for your current job, and if you did not renew ( or alteast file for renew) before it expires you may notbe able to continue the job.
If you are NOT using EAD, but have an EAD on hand you are supposed to keep it valid.
once again - im not an attorney and all above were my understanding.
why dont you talk to your attorney. he/she may have a simple answer for this.

Until now, new inmates booked into the San Diego County Sheriff’s Department had their fingerprints checked only for criminal history information. But now, each new inmate booked into one of the three largest jails in the County will now also have his or her fingerprints checked by the U.S. Department of Homeland Security’s (DHS) biometric system for any immigration record.
The San Diego County Sheriff’s Department is the first law enforcement organization in California to partner with the U.S. Immigration and Customs Enforcement (ICE) in their Secure Communities program. This comprehensive program is intended to streamline the process by which ICE determines if the screened inmate is a criminal alien, subject to automatic removal at the completion of his or her incarceration. Highest priority is given to inmate aliens who have been convicted of crimes such as rape, robbery, murder, kidnapping, and major drug offenses.
By implementing programs like Secure Communities in prison facilities and law enforcement organizations, ICE identified more than 221,000 potentially removable aliens incarcerated nationwide in fiscal year 2008. This fiscal year, the agency anticipates spending more than one billion to continue these programs. As a service to our readers we publish local ceremony dates. If USCIS approves your application for naturalization, you must attend a ceremony and take the Oath of Allegiance to the United States. USCIS will notify you by mail of the time and date of your ceremony.
The notice USCIS sends you is called the "Notice of Naturalization Oath Ceremony" (Form N-445). In some cases, USCIS may give you the option to take the Oath on the same day as your interview. If you decide to take a "same day" oath, USCIS will ask you to come back to the office later that day. At this time, you will take the Oath and receive your Certificate of Naturalization.

You will apply when your number is current on the visa bulletin.
your interview will be scheduled in the 2011 fiscal yr which starts in october.
you can adjust the status in the u.s but be careful with this as the backlog can make it a long wait or you can go home or to the country of last foreign residence and get it done the same day.
any extra questions, send me a private note - i am very familiar with this process.
in the meantime, start collecting your documents for the interview as instructed in the package you will have received.

Hi All,
I am in a strange situation. I was on H1 and applied for H1 extension, I also applied for F1 and got approved for that. Once I received my F1 approval I told my employer to cancel the processing of H1.
Now my employer says that the H1 was approved. Now which status I am in is the main problem. Can I find out which status I am in by any means? what happens if my employer cancels the H1 will i be on F1 or is my F1 no more valid? please can someone help me as I need to take a decision immediately.

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.
Will be a problem if they notice, hopefully they will overlook this. As per the Law you have to be on the payroll at all times unless the company has granted you unpaid leave for a very valid reason such as medical emergency etc.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

I have been waiting for EAD for the last 120 days. I had an info pass inquiry last month. I was told that my I- 765 and AP applications are on hold because of back ground check. Please advice can I get interim EAD from Detroit office while my application is on hold. I have info pass inquiry for next week for Interim EAD, will Detroit USCIS office help me out OR just another endless waiting time. I don�t know what to do, I have been out of work for last 4 months because of work permit. Can anybody advice me, what should I do. I have applied for I-485. Thanks

I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

I am not sure what you mean by 3D designers think they have specialty skills?!
First off you don't have to be a designer to model objects that already exist in real life. You just need to know how to use a 3D Modelling program.
And second - yes - it is a skill to be able to use those programs and even more so if you are actually creating an original design.
And dont go to the "viewpoint" D'espano" or other sites for models they are extremely expensive as you say.
As a side note - depending on a model needed by someone you can ask what you need and alot of times people will create it for you for nothing ;) or have it in stock!

Six years of my H1B expires on Oct 2010. Company A had filed my PERM in April 2009. I was laid off by Company A in Jan 2010. I found another employment and joined Company B in Feb 2010. Company B has filed for H1B transfer with 2 months recapturing while I was outside US thus possibly a visa date of Dec 2010. I've read in this forum that Company B can ask for 7th year extension based on pending LC for more than 365 days with Company A. But my LC from Company A was approved in Feb 2010. Company A will not file I-140 for me. Can someone please tell me if it is still possible for 7th year extension with approved PERM but no pending I-140?
