Hi,
I have been in US for last 2 years on L1 B and my L1 expires in Dec 09.I My company has already applied for renewal. I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.
How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?
My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.
Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.

yes I had LUDS on Nov3, nov and Nov6..approval sent yesterday..
My RFE was about bachelor certificates..only..
because I had submitted all my w2s and tax stuff when i filed concurrently last year on aug 7 2007
Lawyer sent it on Oct 28 and recvd on nov 3..then in 2 days approval..

I have never been to the meeting but will like to attend one if scheduled in future. i think its high time our Chapter schedule meeting with Senators/Congressmen in this area including MD, VA and DC. The President has started the immigration reform initiative and it is right time to make the lawmakers aware of our EB issues. Let me know your thoughts.

For all the friends at IV who have already received their EAD's and/or renewed their EAD's i wanted to ask how long does it take for a person to receive their EAD after filling their 485 provided their date is current. Is filing for EAD an additional step to filling a 485 once the date is current?
2nd scenario: If i decide to change my job and my I-140 is approved with my current employer. The new job is the same level and category as my job description on my current I-140, in a new company. Can i port my PD with the new employer without any affect of I-140 withdrawl from my old employer or will the porting need to be executed prior to my old employer pulling the I-140 petition? I have some understanding about the situation but i wanted multiple opinions just to firm my understanding. Thanks in advance and may GOD help us all through the wait period to get our destinations.

I think someone has given you incorrect information.
A visitor can stay for a maximum of 6 months (180 days - unless person is given earlier date in I-94, which is not usual) At a stretch. If person returns before 180 days, he/she can come back within a day and get a new I-94 and again can stay for 6 months (180 days or the date written on new I-94).
So, person's stay is not governed by number of days in a year, but by the date which is written on I-94. As long as she gets new I-94 with new date, she can stay until that date.
As a side note, what you are confusing with is the tax requirements, which is: If you are claiming a person to be your dependent, he/she must have stayed in the country for atleast 6 months in a calendar year.

Interesting (?!) situation!
One of my relative is on F1 visa, he wants to marry someone in India. He has applied family based GC. Can he bring that person in India thru a visitor visa here to USA and get married here ?
1. Is marriage between two non-immigrants valid in USA ? Can this marriage be registered here ?
2. Will his greencard process be in jeopardy if he gets married during the AOS wait time ?

He can marry in USA..it is not dependent on any visa.. Just check state residency rules..

I have a peculiar issue. I was working with a company from 2000 to 2004 on H1B and then went back to India for good. During that period I applied for Labor.
I joined the same company again and came back to US in Feb 2007 on new H1.
Now I am applying for I-485 for myself, my wife and daughter. My lawyer is saying that I have to fill I-134 (affidavit of support) also. But my salary is around 55K and I don't have much balance in bank. Its around 2-3 K only.
My question is, can I show assets/money from my Indian bank. I have talked to a CA in INdia and he will prepare a statement for me.
I am not sure if I can use that in I-134 or not. Can anybody has done that ?
Any help/suggestion would be appreciated..

Dear All:
I know there are numerous people who are on H4 visa here in the USA and struggling to get out of home and work. All tied up in 4 walls only coz H4 visa holders do not have the authorization to work.
Come on guys, when L2 dependant visa holders can get an EAD and permit to work then why cant H4 dependants get the same privilege ? Is this not a discrimination? Are we not being deprived of the rights that we should be getting? Are we doing justice to our careers? Aren�t 90% of H4 visa holders doctors, engineers, lawyers, MBA�s?? Are we not ruining our careers ? Are we not loosing our self esteem and independence ? are we not highly qualified and skilled to take up challenging jobs in the US ?
We all know what it is with the H1B visa. In such a scenario how can we even expect some professional life for ourselves. But are the law makers aware of this situation of ours ? Laws are amended only when they are put forward and witnessed as a problem and issue of concern. Does the US government know about this ? Does US know that it has immense store house of talent in the form of H4 visa holders ?
It has to change. H4�s should get some kinda reform else we will ruin our careers and life. If you are on the similar line then come forward and join us, in our change!!
Let your voice be heard!! Let H4�s get their independence.

As long as previous employer not revoked/Cancel your i-140 you are safe. You can port your priority date.
But i don't see any body who ported PD even if prior employer cancel or revoke.

I guess it is possible but if your H1 transfer was approved then you might have to apply for another transfer.
No, you don't have to apply for a new H1 if the previous company did cancel your H1 and the H1 has not expired. A dormant H1 can be reactivated at any time.

Can anyone be kind enough to tell me how to talk to a real person at the Vermont Service center? It has been over a month since my employer received the receipt number from USCIS, but the case cannot be found online. I tried calling the number below, but the robot that talks says the same detais that I can find online.

My wife is currently on H4 status. (Just the I-94, her visa expired last year October). She started her MS in Fall 2009. She already competed 2 Semesters of MS on H4 visa. We applied for her Change of Status to F1 visa in March. According to the USCIS processing dates, she will get the COS approved approximately in June 1st week.
She will have to travel to India this summer. The question we have is,
is it advisable to wait till she gets her F1 COS Approved and then go to India for F1 Stamping ?
or abandon the F1 COS and go for F1 stamping directly in India ?
Please advice if there are any risks involved here.
It is the same either way. Once she goes out, she would need a visa stamp to get back in. And the consulate will do whatever they needs/wants to do for approving (or not approving) the visa petition regardless of whether or not she was in F1 status before leaving US.
